In Summary

If you have a business or financial dispute of any kind, mediation offers the opportunity to resolve it cooperatively and effectively without going to court. (You can also book a mediation even if there is a pending court case).  Even if you have unsuccessfully tried speaking with the other person or company before, mediation often results in a successful outcome.  Mediation is a meeting between the two of you, usually held by Zoom where the issues are discussed and the mediators, who are trained in leading these discussions, help you to agree on a plan for resolution.

The process:
  1. We speak with each of you separately.
  2. If everyone agrees that we are to be your mediators, we book a three hour Zoom session (sometimes cases take longer, we will discuss this)
  3. We hold the mediation session (usually by Zoom).
  4. When an agreement is reached (and it usually is) you both sign the agreement (e-sign) and it becomes a legal agreement between you documenting your plan to resolve your situation.

Useful facts to consider:
  1. Coming to mediation is a no-lose proposition. If you do not reach an agreement in the mediation session, then you can simply proceed however you were going to before the mediation session, including going to court. But at least you will know that you tried to work things out, and in fact you are most likely to come to an agreement during the mediation session.
  2. You do NOT need to file a court case before coming to mediation. If you do not reach an agreement in mediation, then you can file a court case if you want, or take whatever other steps you need to take.
  3. Mediation is confidential. Nothing discussed in mediation can be revealsed outside of the meeting. This makes mediation suitable for sutiations where the parties do not wish for their affairs to be made public.
  4. We do not need lots of paperwork. Oftern a 1-2 paragraph summary of your situation will suffice, and we can usually take that information during our initial consultation call.
  5. Mediation is much faster and cheaper than litigation! Situations can be resolved in one session that might take months in court.
  6. We always mediate in pairs, so that you will have two mediators conducting your mediation.

Costs:

We are currently running an introductory rate for civil cases (business or financial) as we introduce our services nationwide. We charge a flat rate for a three hour mediation session.  All other calls, emails, and administration is included. We have an initial setup fee per case which is currently waived. Fees are commonly (but not always) split between the parties, so we show the per-party fee.

What is Civil Mediation?

Civil mediation is a process where a neutral third party (the mediator) helps disputing parties reach a mutually agreeable resolution. Unlike a judge or arbitrator, the mediator does not make a decision but facilitates a constructive dialogue, helping parties identify common ground and explore potential solutions.

  • Experienced Mediators: Our panel includes skilled and experienced mediators with expertise in various areas of civil law.
  • Efficient Dispute Resolution: Mediation often resolves disputes much faster than going to court, saving you time and money.
  • Confidential Process: All discussions and negotiations in mediation are confidential, protecting your privacy.
  • Mutually Agreed Outcomes: Mediation empowers you to control the outcome, leading to solutions that work for everyone involved.
